Signature Validity, Enforceability or Registration? Egypt Property Guide
You bought a flat on a preliminary contract, and now people tell you to file a "signature validity" case, a "validity and enforceability" case, or to register at the Real Estate Registry. The short answer: signature validity only proves the seller signed; validity and enforceability confirms the sale itself; registration is what puts registered ownership in your name. This guide explains the difference and what Egypt's 2022 registration reform changed. It is general information, so ask a property lawyer about your own case.
Signature validity case (sehet tawqee)
A protective case that proves the signature on the contract is genuinely the seller's. The court does not examine the contract's terms, the seller's ownership or whether the sale is valid. It stops the seller from later denying the signature, but it does not transfer ownership and is not enough to register the flat.
Validity and enforceability case (sehet wa nafaz)
A fuller case asking the court to declare the sale valid and binding. The court looks at the seller's ownership, both parties' capacity and any ground that would void the contract. Published registration procedures list a final ruling of this kind among accepted proofs of possession. It usually takes longer and costs more.
Registration at the Real Estate Registry
Registration makes ownership official and enforceable against third parties. Without it you rely on an informal contract or a court ruling, which can complicate resale, mortgages and bank finance.
What the 2022 reform changed
Law 9 of 2022 amended the registration law, and the new procedures started in May 2022. According to Youm7, citing the justice minister at the time:
- The 2.5% property disposal tax was separated from registration. It is the seller's obligation and no longer a condition for the buyer to register.
- Holders of a preliminary contract with five years of proven possession, for example via a utility bill or the address on their national ID, can register, as can anyone with fifteen years of possession.
- The registry has 30 days to decide, plus 7 days for objections.
Registration fees
The head of the Real Estate Registry told Sada El Balad in 2021 that residential fees are tiered by size:
| Unit size | Stated fee |
|---|---|
| Up to 100 sqm | EGP 500 |
| Up to 200 sqm | EGP 1,000 |
| Up to 300 sqm | EGP 1,500 |
| Over 300 sqm | EGP 2,000 maximum |
These figures date from 2021 and other form or service fees may apply, so confirm current fees at your registry office.

FAQ
Does a signature validity ruling make me the owner?
No. It only proves the seller signed.
Can I register with a preliminary contract?
Since 2022, yes in some cases, such as five years of proven possession. A lawyer or the registry can confirm whether you qualify.
Who pays the 2.5% disposal tax?
The seller, and it is no longer a condition for your registration. Put it in writing anyway.
How long does registration take?
The law sets 30 days for a decision and 7 for objections; complete paperwork is what keeps it on track.
